As we are aware, some helpers filed an OA 1949/2012 in CAT Delhi for grant
of ACP in Technician Scale.
CAT Delhi allowed this OA and with the support of ARTEE the orders were
issued by O/o ADG(E), North Zone. The eligible helpers who were applicants
in this case have got the benefit of ACP in Technician Scale.
Sensing the urgency, ARTEE also filed OA 3607/2014 for extending the same
benefit to all eligible Helpers. The CAT Delhi gave a clear verdict to
grant this benefit.
After this DG (AIR) filed a Review Application in OA 1949/2012 in CAT
Delhi itself. DG (AIR) issued a speaking order to us in the OA
3607/2014, indicating that this benefit shall be extended as per
outcome of the Review Application filed in CAT in OA 1949/2012.
CAT Delhi dismissed the Review Petition and the Government then filed a
Writ Petition in Hon’ble High Court Delhi. The Government filed a Writ in
our case and it was listed on 8th Dec 2015 along with the Writ Petition of
OA 1949/2012.
The Hon’ble High Court has clubbed these two cases and other Case filed by
Helpers of O/o ADG (NZ), Jam Nagar House, Delhi.
Some people are questioning this clubbing our reply is:
[1]. It is done by the Hon’ble High Court itself and we have neither filed
any application for this nor argued for it.
[2]. Should we wait for litigation to be over in original case which may
take further years. In such case also we have to file an OA to extend the
benefit to our members.
This is the mistake we have been doing in the past. Waiting for no reason
and decades are passing. Now the hearing of all the case will be done
simultaneously.
Next date of hearing is on 8th April 2016.
